Limitation of Liability

Apart from where forbidden by law, in no case shall INUI be accountable to You for any indirect, consequential, illustrative, incidental or punitive damages, including lost profits, even if INUI has been advised of the probability of such damages.

Indemnity

You hereby give your consent to indemnify and exclude INUI, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries and affiliates from any demands, loss, accountability, assertions or spendings (inclusive of attorneys’ fees), brought against INUI by any Third Party due to or arising out of or relating to your use of the Site.

If, notwithstanding the other provisions of these Terms of Use, the entire liability of the Company and any of its suppliers under any provision of these Terms, and Your exclusive remedy for all the foregoing shall be limited to the amount actually paid by You on the Site strictly within 6 months before any claim is raised against INUI or to a maximum amount of 100 USD, if You haven't purchased anything through the Service.

Violation of These Terms of Use

INUI may reveal any information and/or data We have about you, if it is determined by us that such disclosure is essential and necessary with regards to any administrative and/or legal examination, investigation and/or administrative/legal complaint concerning your use of the Site, or to diagnose, identify, approach or take legal action against someone who may be -intentionally or unintentionally- causing damage, injury to or interference with INUI’s rights or property, or the rights or property of visitors or to Users of the Site, including INUI’s customers. If INUI does bring any legal action against you as a result of your violation of these Terms of Use, INUI will be entitled to recover from you, and you consent to pay all attorney fees and costs of such action (inclusive of official fees), aside from any other relief bestowed upon INUI by the law. You hereby agree that INUI will not be held accountable to you or to any Third Party for termination of your access to the Site as a result of any violation of these Terms of Use.

Governing Law; Jurisdiction and Venue; Dispute Resolution

You hereby acknowledge that all matters with respect to your entry to and/or use of the Site, including all disputes, shall be governed by the laws of the UAE. You hereby agree to the jurisdiction and venue of the federal courts of the UAE and relinquish any opposition against such jurisdiction and venue.

Any claim by You under these Terms of Use must be raised within 6 months of the date of cause of action failing which will result in loss of any such claim and no recovery may be pursued, sought or gained for damages. In the event of any conflict and/or dispute between INUI and You arising out of or in connection with your use of the Site, the parties shall make an attempt promptly and in good faith, to settle any such conflict, controversy and dispute.

If we are unable to settle any such dispute within a reasonable time not exceeding 15 (fifteen) days, then the INUI may submit such conflict or dispute before the Dubai International Arbitration Centre as well. Any dispute, difference, controversy or claim arising out of or in connection with this contract, including (but not limited to) any question regarding its existence, validity, interpretation, performance, discharge and applicable remedies, may also be referred to and resolved by Dubai International Arbitration Center. The number of arbitrators shall be 1 (one). The seat, or legal place of arbitration shall be Dubai International Financial Centre. The language to be used in the arbitration procedures shall be English. Each party shall bear its own costs and fees with respect to arbitration proceedings.

Miscellaneous

If any provision of these Terms is held to be unenforceable or invalid, such provision will be modified and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will be fully enforced and be in effect.

All rights not expressly granted herein are reserved and retained by the Company.

Prevailing Language

The English language version of these Terms and Conditions shall be governing in all forms and shall prevail in case of any dispute and/ conflict with translated versions, if any.

Changes of These Terms and Conditions

INUI reserves the right, at its exclusive discretion, to alter, modify, add or expunge parts of these Terms and Conditions, at any time. It is completely your liability to review these Terms of Use regularly for alterations, if any. Your extended use of the Site following the posting of modification shall mean that you acknowledge and give your consent to the modifications. Insomuch as you comply with these Terms of Use, INUI bestows upon you a personal, comprehensive, non-transferable, limited liberty to enter and use the Site.
